Terms of Service

These Terms of Service ("Terms") govern your access to and use of Nova Pixel Analytics (the "Service"), operated by Nova Pixel Analytics ("we", "us", "our"). By creating an account, starting a free trial, or subscribing to the Service, you agree to these Terms.

1. The Service

Nova Pixel Analytics is a multi-platform marketing and conversion analytics platform that lets you connect third-party data sources (including Google Analytics 4, Google Search Console, Meta Ads, WooCommerce, Keap, Mailchimp, ActiveCampaign, Zoom, Wistia, and AddEvent) and view consolidated reports, funnels, dashboards, automated scheduled email reports, and AI-assisted insights.

2. Accounts and Workspace Access

You must provide accurate account information and keep your credentials secure. You are responsible for all activity occurring under your account and within workspaces you own or manage. You must be at least 16 years of age and legally authorized to connect any third-party platforms or data sources you link to the Service.

3. Free Trials, Subscriptions, and Billing

• 14-Day Free Trial: New accounts receive an automatic 14-day free trial upon registration, providing access to 1 workspace, up to 3 reports/funnels, and 1 user seat. No credit card is required to begin a trial.
• Subscriptions and Add-ons: Paid access is provided on a monthly recurring subscription (Base Pro Plan at $29/month, including 1 workspace, 10 reports, and 2 team seats). Additional capacity can be added via modular add-ons (Extra Workspace at $29/month including +10 reports and +2 seats, Extra 10 Reports at $9/month, and Extra 2 Seats at $9/month).
• Payment Processing: Payments and subscription management are securely processed by our third-party payment partner, Stripe, Inc. By providing payment information, you authorize Stripe to charge the applicable recurring fees and prorated charges to your designated payment method. We do not store or process your full credit card numbers on our servers.
• Proration: When you purchase add-ons or increase capacity during an active billing cycle, charges are calculated on a prorated basis for the remainder of that billing period.
• Cancellation: You may cancel your subscription at any time via the Stripe Customer Portal in your account Settings. Cancellations take effect at the conclusion of your current prepaid billing period. Fees are non-refundable except where required by law.
• Trial Expiration and Inactive Accounts: If your trial expires without an active subscription, or if a recurring payment fails, your account transitions into a safe read-only state. Your existing workspaces, funnels, and historical reports remain intact and accessible to you in read-only mode, but live data synchronization will pause and new funnel/workspace creations will be restricted until an active subscription is established.

4. Acceptable Use

You agree not to: (a) access or attempt to access accounts or data you do not own or have permission to manage; (b) reverse engineer, decompile, or overload the infrastructure of the Service; (c) use the Service to violate applicable laws or third-party terms (including Google API Services Terms or Meta Platform Terms); or (d) resell or redistribute the Service without written authorization.

5. Third-Party Integrations and APIs

The Service connects to third-party services and APIs that we do not own or control. Data availability, rate limits, and platform access are subject to the policies and terms of each respective platform. We are not responsible for third-party platform outages, policy changes, or data inaccuracies arising from connected third parties.

6. Your Data and Ownership

You retain full ownership and intellectual property rights in all analytics data, credentials, and configurations you connect to the Service. You grant us a limited, revocable license to process, cache, and format your data solely for the purpose of providing the Service, generating reports, and delivering scheduled communications as outlined in our Privacy Policy.

7. Artificial Intelligence Features

AI insights and funnel audits are generated using automated machine learning models (including Google Gemini). These insights are provided for informational purposes only and do not constitute formal business, financial, or marketing advisory services. You remain solely responsible for any decisions or optimizations implemented based on such insights.

8. Disclaimers and Warranties

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Nova Pixel Analytics or its affiliates be liable for indirect, incidental, special, consequential, or punitive damages. Our total aggregate liability arising out of or relating to your use of the Service will not exceed the total fees paid by you to us in the twelve (12) months preceding the event giving rise to liability.

10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of United States, without regard to its conflict of law principles. Any dispute arising under these Terms shall be resolved in the courts of United States.
